DISCLAIMER

You expressly understand and agree that: (a) this site and any of the services are provided on an "as is" and "as available" basis and that this site makes no warranties, representations or conditions (as used in this section "warranties") of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement and that any such warranties are hereby expressly disclaimed, and (b) this site specifically makes no warranties that a it or any of its services, including any content, information, products or services obtained from or through the use of this site or any of the services, will be provided on an uninterrupted, timely, secure or error-free basis or that such services or the results derived therefrom will meet your requirements or expectations.

TICKET TERMS AND CONDITIONS

The Ticket Factory acts as an agent for Promoters and Organisers and tickets are issued on behalf of the organisation staging the event as identified on the face of the ticket.

The Promoter/Organiser reserves the right to:
- make reasonably necessary alterations to the advertised event arrangements, featured participants or programme
- cancel or abandon any event without notice and without liability for compensation or damage other than up to a maximum of the ticket price (If an event cancels in advance we will make reasonable attempts to contact you using the details you have provided)
- restrict ticket sales to a maximum number per person and/or household and cancel any tickets purchased in excess of this.

The venue reserves the right to:
- refuse admission to, or remove you from the venue in reasonable circumstances - such as the refusal of security checks or if venue staff consider that your behaviour may adversely affect other people's enjoyment of the event and without a refund
- require latecomers to wait until a suitable break in the performance before being admitted
- provide alternative tickets at the event should the staging of the event so require e.g. due to unavoidable seating changes
- confiscate prohibited items such as bottles, cans, food and drink not purchased at the event, cameras or items that may potentially be used as a weapon - in accordance with its policies. If in any doubt please check with the venue before attending.

Tickets cannot be refunded unless an event is cancelled or rescheduled so please check your tickets carefully on receipt and contact us immediately if you have any queries. We are not liable for lost, destroyed or stolen tickets and cannot always replace them. Please take special care of standing or other general admission tickets as for many venues duplicates cannot be issued under any circumstances.

Tickets are not transferable and their resale for profit or commercial gain ( except by us or our authorised sub-agents) or use in promotions or packages without the express permission of the Promoter / Organiser is prohibited and may render them void Please check details such as timings and car park charges with the venue before travelling as these may be subject to late changes.

You must produce a valid ticket to attend the event and removing parts of, defacing or otherwise altering your ticket may render it void If you experience any problems with your seating or enjoyment prior to or during the event please inform venue staff immediately as issues cannot always be resolved after the event. Please note loud music or noise can damage hearing The unauthorised use of cameras, video or sound recording equipment is prohibited at the event and such items may be confiscated By attending the event you consent to being filmed / recorded as part of the audience for security and broadcast without payment.

LIMITATION OF LIABILITY

You expressly understand and agree that in no event shall this site, including its affiliates and licensors, be liable for any damages whatsoever, including any direct, indirect, incidental, consequential, special or exemplary damages, and any damages for loss of profits, savings, goodwill or other intangible losses, regardless of whether this site had been advised of or could have foreseen the possibility of such damages, arising out of or in connection with: (a) the use, inability to use or performance of any of the services of this site, or (b) any unauthorized access to or modification to any of your content or transmissions, or (c) any other matter relating to this site or any of the services. We attempt to ensure that the information available on the web site at any one time is accurate. However, we cannot guarantee that it will be fault free and we cannot be responsible for goods and services offered by us as agents for third parties or for any aspect of the relationship between you and that third party. We do not accept liability for any errors and/or omissions and reserve the right to change any of the information found at this site at any time without notice. We do not accept liability for any indirect or consequential loss arising out of the use of or the inability to use the web site or for any products or services purchased from the web site. We will only be liable for direct loss (save in the case of death or personal injury in respect of which there is no limit) up to a maximum total of the price of the product or service purchased. This liability section only applies to the extent permitted by law.

JURISDICTION

Every purchase you make shall be deemed performed in England. English law shall govern every aspect of contractual agreement concerning purchases made from us. These terms contain the entire agreement between you and The Ticket Factory relating to your purchase. The invalidity or enforceability of any term shall not affect the validity or enforceability of any of the other terms.

USE OF THIS WEBSITE

You undertake that all details you provide to us for the purpose of booking, ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the product or service. If there are any changes to the details supplied by you it is your responsibility to inform us. Confirmation of receipt of your order by e-mail, does not guarantee the ticket sale. Credit card sales will be encrypted.

GIFT VOUCHERS TERMS AND CONDITIONS

The Ticket Factory Gift vouchers are available for purchase by telephone on 0344 338 8000, by post at The Ticket Factory, PO Box 3348, Birmingham, B40 1NT and at the NIA Box Office or LG Arena Box Office. The Ticket Factory will supply gift vouchers in accordance with these terms and conditions: Whenever possible gift vouchers will be dispatched within 2 working days. Please note that the date of dispatch and delivery to a customer is not of the essence. All gift vouchers purchased by telephone or post will be delivered by secure means to the address given by the customer at the time the order was placed. Secure delivery will be subject to an additional fee. The customer must notify The Ticket Factory of any discrepancy in a delivery as soon as possible but in any event within 3 days of the delivery of the gift vouchers. Risk of loss, destruction or damage to the vouchers remains with The Ticket Factory until delivery to the customer's address or nominated address where upon risk shall pass to the customer or recipient. Upon receipt please take care of your gift vouchers as they will not be replaced if lost, stolen or destroyed. Gift vouchers may not be redeemed for cash in any circumstances. Vouchers are not sold on a sale or return basis and no return will be permitted unless it can be demonstrated that The Ticket Factory has been in error in fulfilling the customer's order. The Ticket Factory reserves the right to refuse to accept incomplete, damaged or altered gift vouchers. Photocopies of vouchers will not be accepted in any circumstances. Vouchers may be used in whole or part payment for tickets to the value indicated on the voucher. Vouchers cannot be exchanged for other goods or cash or be applied to the payment of tickets already supplied.

GIFT VOUCHERS ARE REDEEMABLE AGAINST EVENTS BEING SOLD BY THE TICKET FACTORY FOR LG Utilita Arena Birmingham, OR THE NIA, BIRMINGHAM ONLY.

Gift vouchers must be redeemed in person at The LG Arena box office, The NIA box office or by post at the following address: The Ticket Factory, PO Box 3348, Birmingham, B40 1NT. When booking by post, please include your name, address, daytime telephone number and the event you wish to book for. In the event that the value of the tickets exceeds the value of the gift vouchers extra payment must be provided at the time of booking. In the event that the value of the tickets is less than the value of the gift vouchers change will be given in gift vouchers. The Ticket Factory reserves the right to refuse to accept an order and also reserves the right to immediately suspend the fulfillment of an order if the customer is in breach of any of these terms and conditions. The Ticket Factory reserves the right to alter any of the above terms and conditions but undertakes that before so doing it will serve a reasonable notice upon the customer. The customer may not vary the terms and conditions and any attempt to vary these terms and conditions will not be affective unless it is in writing and signed on behalf of The Ticket Factory. If any of the provisions of this agreement shall be found by any court to be invalid or unenforceable such invalidity or unenforceability shall not affect the other provisions of this agreement which shall remain in full force and effect. A person who is not a party to this agreement will acquire no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce or take the benefit of any of these terms and conditions. This agreement shall be governed by and construed in accordance with the laws of England and the English courts shall have exclusive jurisdiction. The Ticket Factory is a trading name of the National Exhibition Centre Limited.

SAFETY AND ENJOYMENT

In accordance with UK legislation, it is an offence to smoke in all enclosed public spaces. Dogs are not permitted on the premises, with the exception of Assistance Dogs. Please take care of all personal property brought onto the premises. Official merchandise is only available inside the premises.

CAR PARKING

The following conditions apply when purchasing a car parking ticket:

Advance car parking tickets booked through The Ticket Factory can only be purchased with event tickets in one single transaction. The car parking ticket is to be given up on exit from the car park. The car parking ticket is only valid on the date displayed on the car parking ticket. Cars are parked at your own risk and we will not be liable for any loss or damage whatsoever or howsoever caused or sustained to, by or in respect of any cars or their contents. The NEC Group reserves the right to search the interior, exterior or contents of your car in reasonable circumstances e.g. where there may be a security risk. The NEC Group reserves the right to move your car in reasonable circumstances e.g. when causing an obstruction or posing a security or safety risk.
